Terms of use

The short version

• Only a parent or another adult 18 or older can create a Speakeeper account. Children use Speakeeper only under a parent's account, after the parent has given consent.
• Your family's recordings belong to your family. You can download them at any time, and the Voice Book is yours to keep as MP3 files.
• The Family Plan costs USD 49.99 a year or USD 6.99 a month for the whole family, with a 7-day free trial. Plans renew automatically unless you turn renewal off, and we email you first.
• A purchase made on our website can be refunded in full if you ask within 14 days. Purchases in the App Store or Google Play follow Apple's or Google's refund rules.

Who we are

Speakeeper is operated by Hausbound, LLC, 1300 Rt 17 North Ste 1, Ramsey, NJ 07446. You can reach us by email at support@speakeeper.com or by phone at (201) 785-7309. In these terms, "we" and "us" mean Hausbound, LLC, and "you" means the person using Speakeeper.

Accounts and children

• Only a parent or another adult 18 or older can create a Speakeeper account, and the account holder is responsible for it. You can sign in with email, Sign in with Apple or Google sign-in.
• Children never sign in or create an account. A child uses Speakeeper only under a parent's account, after the parent has given consent. A family plan covers up to 4 children and 2 adults who play, plus the parents who manage the account.
• A grandparent or other relative joins through a link or QR code a parent shares, without an account of their own.
• Every adult whose voice is saved agrees for themselves to being recorded before their first recording. An adult can stop at any time.
• Please keep your sign-in details and your family's links to yourself, and tell us at support@speakeeper.com if you think someone else has used your account.

Your family's privacy

Our privacy policy explains what we collect, why, who can hear and see it, how long we keep it and how a parent can download or delete it. It is part of these terms, and it governs how we handle your family's information. The link is at the end of these terms.

Using Speakeeper fairly

Please use Speakeeper only for its purpose: a family teaching and learning its language together. You agree not to:

• break the law, or use Speakeeper to harm a child or anyone else;
• record anyone who has not agreed to be recorded;
• mark a song to share unless it is traditional, your own, or one you are comfortable sharing with your family;
• try to get into another family's account, recordings or links;
• copy, resell or republish the app, the site or its content, or interfere with them, overload them or use automated tools to scrape them.

Trial, plans and billing

• The Family Plan costs USD 49.99 a year or USD 6.99 a month. One price covers the whole family: it is never charged per child, per device or per language. The price is the same on our website, in the App Store and in Google Play. Sales tax is added to website purchases where it applies.
• A new plan starts with a 7-day free trial. Before you buy, the screen shows the price, the billing period, the trial end date and the date of the first charge.
• Plans renew automatically each month or each year until you turn renewal off. You can turn it off at any time in the parent area. A plan bought in the App Store or Google Play is managed in that store's subscription screen.
• We email you 3 days before a trial ends, 7 days before a yearly renewal and 7 days before each monthly renewal, with the date, the amount and a link to turn renewal off.
• You can cancel at any time from the parent area, without contacting us. After you cancel, your plan keeps working until the end of the period you paid for.
• A printed edition of the Voice Book is an optional extra, sold on our website. Its price, shipping and tax are shown before you pay.
• Purchases are available only to customers in the United States.

Gift years

• Anyone can buy a gift year on our website for USD 49.99, the same price as the yearly plan. It is one payment; the person who gives it is never charged again.
• A gift code works once and can be redeemed for 5 years from the date it was bought.
• A redeemed gift gives the family 12 months of the Family Plan, with no automatic renewal. We email the family 7 days before it ends, and nothing is charged.
• The person who gives a gift has no access to the family, its recordings or its progress.
• A gift is a purchase made on our website, so the refund rule below applies. If a redeemed gift is refunded, the family's gift year ends.

Refunds

• A purchase made on our website can be refunded in full if you ask within 14 days of the purchase. Email support@speakeeper.com from the address on your account, or the address you used to buy a gift.
• Refunding the first payment of a subscription also ends the subscription. Each later renewal can be refunded in full if you ask within 14 days of that renewal's charge.
• Purchases made through the App Store or Google Play follow Apple's or Google's refund rules, and you ask Apple or Google for the refund.
• When a refund ends a plan, you can still download your family's recordings, as described below.

Your family's recordings

Your family's recordings, word cards and Voice Book belong to your family. We keep them only to run Speakeeper for you, as our privacy policy describes. We never sell them, never use them for ads and never use them to train computer programs.

A parent can download every recording as one archive at any time, on every plan and after a plan ends. A parent can also save the Voice Book as MP3 files that your family keeps on its own devices. When a plan ends, the Voice Book stays available to play and download for 60 days, and we email you before that window closes; then our copy is deleted. Your downloaded files are yours to keep.

A parent can delete any recording at any time. Copies a parent has already downloaded or shared are outside our control.

The app, the site, the games, the pictures and avatars we draw and our written content belong to Hausbound, LLC. You may use them for your own family's learning.

United States only

Speakeeper is offered only in the United States, and purchases are available only to United States customers.

Deleting your account and ending these terms

• You can stop using Speakeeper at any time. Please download your recordings first.
• A parent can delete a child or a relative, with all their recordings, at any time. Any parent can remove their own login and information at any time.
• Deleting the whole family account needs every parent with a login to agree. If you are the only parent with a login, it happens right away after you confirm. If there is another parent, they are told and can agree or stop it; if no one stops it, the family is deleted 30 days after the notice was delivered. Our privacy policy explains each step.
• A family with no plan and no activity for 18 months is deleted after two warning emails, as our privacy policy describes.
• Deleting the account does not cancel a plan bought in the App Store or Google Play; cancel it in the store.
• We may suspend or close an account that breaks these terms or puts a child or another family at risk. If we do, we will tell the account holder by email, unless the law does not allow it.

Disclaimers

We work hard to keep Speakeeper working, but we provide it "as is" and "as available." Speakeeper helps a family practice its language together; it does not promise that anyone will become fluent. To the extent the law allows, we make no promises beyond those in these terms, including any implied promise that Speakeeper will suit a particular purpose, will always be available or will be free of errors.

Limits on our liability

To the extent the law allows, Hausbound, LLC is not liable for indirect, incidental, special or consequential losses, such as lost data or lost time, that come from using Speakeeper. Our total liability for any claim about Speakeeper is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing. Some states do not allow some of these limits, so they may not all apply to you. Nothing in these terms limits a right you have that the law does not let us limit.

Governing law and disputes

These terms are governed by the laws of the State of New Jersey. If you have a problem, please contact us first at support@speakeeper.com; most issues can be solved that way.

Any dispute about these terms or Speakeeper goes to the state or federal courts in Bergen County, New Jersey. Either side may use small claims court where the claim qualifies. There is no arbitration requirement and no class-action waiver in these terms.

Changes to these terms

When we change these terms, we will post the new version here with a new effective date. If a change matters to how you use or pay for Speakeeper, we will also tell account holders by email or in the app before it takes effect.
